By accessing or using Swell ("the app", "the service") at swellapphq.com or via our mobile app, you agree to these Terms of Use. If you do not agree, do not use the service.
Use of the Service
Swell provides beach condition scores and recommendations for informational purposes only. You may use the service for personal, non-commercial purposes. You agree not to:
- Scrape, crawl, or automate requests to our service
- Attempt to reverse-engineer our scoring algorithms
- Use the service to build a competing product
- Submit false, misleading, or harmful user-generated content
- Violate any applicable laws or regulations
Accuracy of Information
Beach condition data is sourced from third-party weather and tide APIs. Swell makes no guarantee of accuracy, completeness, or fitness for any particular purpose. Always use your own judgement before entering the water. Conditions can change rapidly — never rely solely on app scores for safety decisions.
User-Generated Content
By submitting content (photos, posts, check-ins), you grant Swell a non-exclusive, royalty-free license to display and distribute that content within the service. You represent that you own or have rights to any content you submit. We reserve the right to remove content that violates these terms.
Affiliate Links
Swell may display hotel and activity links via Booking.com and Viator affiliate programs. If you click and complete a booking, Swell may receive a commission at no additional cost to you. These partnerships do not influence our beach scores or recommendations.
Accounts
You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@swellapphq.com if you suspect unauthorized access. We reserve the right to terminate accounts that violate these terms.
Disclaimers
The service is provided "as is" without warranties of any kind. Swell is not liable for any injury, loss, or damage arising from use of the service or reliance on beach condition information.
Changes
We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
